A multi-million pound settlement has been reached between Tom Cruise and Katie Holmes to end their marriage.

According to MSNBC, the pair agreed to a 100-page pre-nuptial agreement that said Holmes would get close to £2 million ($3 million) for each year of the marriage.

A New York court approved the couple’s speedy divorce on Monday, and it was then officially finalized.

According to Sheila Riesel, Cruise’s attorney, “The matter is finally resolved and over. All records are confidential and not available in any format for disclosure,”

Holmes would have earned half of Cruise’s estimated £160 million wealth ($250 million) if their marriage had lasted longer than 11 years.

Instead, she will allegedly get their $35 million Beverly Hills property as well as $15 million in payment for the five years of marriage.

Holmes gets custody of their six-year-old daughter Suri, while her ex-husband keeps most of his estimated 160-million pound fortune.

Top divorce attorney Vikki Ziegler told Hollywoodlife.com: “Most of the estate is Tom’s. She’ll have to go for a lot of child support. She’ll have to show that Suri has nannies, cars, activities, clothes, hair appointments. That a hefty amount each month is needed to maintain Suri’s lifestyle.”

However, sources close to Tom says Katie’s version of events are baffling, telling gossip website TMZ he had ‘no idea’ she was going to legally end their marriage.

Holmes also claimed both she and Tom have been residents of New York for ‘at least two years’, even though their main family home is in Beverly Hills, California.

She must establish legal residency in New York in order for the court to have jurisdiction, which is something she wants because New York courts are more likely to grant her sole custody of Suri.

However, 49-year-old Tom – who also has two children, Isabella, 19, and 17-year-old Connor, with second wife Kidman – will fight the residency claim and wants the legal proceedings switched to California, where courts are more likely to grant joint custody of a child.

Since the news of the divorce was announced, Tom admitted he was ‘deeply saddened’ but sources claim he will respond by filing his own divorce papers in California.

The divorce will be Cruise’s third after Nicole Kidman in 2001 and actress Mimi Rogers in 1989 – both of whom were also 33 years old when they split from the Scientologist. However, this is the first time that Top Gun star isn’t the one filing the divorce papers.

The 33-year-old actress, who found fame in the TV series of Dawson’s Creek, is said to have sought advice from her lawyer father regarding the separation from Cruise.

However, her legal team are now working hard to lock down a final figure on Cruise’s wealth. It has been reported that Holmes has already employed specialist forensic accountants to untangle the complex web of businesses and trusts that manage Tom Cruise’s fortune.

Sources have revealed to the Mail that the 33-year-old is asking for a ‘suitable amount’ of child support, as well as a division of property, though no mention was made of the pre-nuptial agreement in divorce papers.

Once the divorce is finalised both Katie and Tom will keep their respective earnings from the projects they’ve worked on since November 2006.

Meanwhile it has been claimed that neighbours of the actress called police last week amid fears she was being followed.

Law enforcement were first alerted to the unidentified men surrounding Katie’s Chelsea apartment building on Friday, but were unable to take any action because the former Dawson’s Creek star didn’t make the call herself, sources tell the New York Post.

Yesterday, the men, who were reportedly armed, were pictured sitting inside a white Cadillac Escalade, taking pictures and questioning several people outside of the actress’s apartment building.

And as fears, suspicion and speculation mounted, the mysterious car was finally approached yesterday by police.

According to the Post, police checked the vehicle’s Tennessee number plates and questioned the men inside, but could not elicit any substantial answers.
