Actress Paz de la Huerta sues Harvey Weinstein, alleges rape

Actress Paz de la Huerta has filed a lawsuit against Harvey Weinstein, alleging that he raped her in 2010 and subsequently harassed her in a manner that damaged her career.

The lawsuit, filed on Tuesday, claims that Weinstein raped de la Huerta twice in New York in December 2010 and then taunted her with phone calls between the two assaults.

De la Huerta’s lawsuit also alleges that the following month, Weinstein exposed himself to her in a Beverly Hills hotel and attempted to coerce her into having a s**ual encounter with him and another woman.

De la Huerta was fired from HBO’s “Boardwalk Empire” about a year after the incidents.

The lawsuit suggests that she believes that Weinstein was involved in her dismissal, citing a photo of Weinstein talking to Martin Scorsese, an executive producer and director on the show, just weeks before her firing.

New York police announced last year that they were investigating de la Huerta’s allegations.

Although the Manhattan District Attorney’s office declined to add de la Huerta to the criminal case against Weinstein, police officials and Mayor Bill de Blasio called her claims “highly credible.”

De la Huerta’s lawyer, Aaron G. Filler, told the New York Times that the lawsuit will use archival photos to corroborate de la Huerta’s claims and demonstrate that both she and Weinstein were at the locations where the assault occurred.

He also said that he had forwarded additional evidence to the district attorney’s office on Sunday.

Weinstein’s attorney, Ben Brafman, pointed out the lack of charges against Weinstein in New York in response to the suit.

He called de la Huerta’s “newly minted version of events including her new California claims…preposterous” and suggested that they were the product of an unstable personality with a vivid imagination.

De la Huerta’s lawsuit alleges that Weinstein first pressured her for s** in her apartment after a party celebrating the premiere of the film “Blue Valentine” in 2010 and threatened to harm her career if she didn’t comply.

When she refused, Weinstein raped her.

The lawsuit claims that he then taunted her with phone calls for two weeks until she agreed to see him at her apartment on December 23 with the intention of demanding that he stop calling.

She drank heavily in anxiety, making her vulnerable, and Weinstein raped her again.

In January 2011, de la Huerta again tried to confront Weinstein when they were both in Los Angeles for a series of awards-season events.

Her lawsuit claims that Weinstein opened the door of his Four Seasons Hotel room, exposed himself to her, and invited her to have a s**ual encounter with him and another woman who was undressed.

De la Huerta left feeling “embarrassed, scared, shocked and humiliated,” according to the lawsuit.

After drinking excessively, she was denied entry to a GQ party at the Chateau Marmont, and photographers captured video of her drunkenness, further damaging her reputation and career.

De la Huerta’s lawsuit alleges that Weinstein damaged her career by at least $60 million.

Ashley Judd, who is among numerous women suing Weinstein, has filed her own lawsuit alleging that Weinstein hurt her career and prevented her from obtaining at least one role.

In her lawsuit, Judd cites an interview last year with director Peter Jackson, who said that Weinstein warned him against hiring Judd and Mira Sorvino for his “Lord of the Rings” films.

Both women have accused Weinstein of s**ual harassment.

More than 75 women have accused Weinstein of wrongdoing.

Weinstein has denied all allegations of nonconsensual s**, and his attorney has challenged the credibility of his accusers.

Weinstein faces criminal charges in New York over allegations that he raped an unidentified woman in his hotel room in 2013 and performed a forcible s** act on a different woman in 2006.

A judge recently agreed to dismiss charges related to a third accuser, Lucia Evans, after evidence emerged that a police detective had coached a witness to stay silent about evidence that cast doubt on her account.

Weinstein has pleaded not guilty to the remaining five counts.
