Marisa Tomei confronts Harvey Weinstein in court over rape

After a court declined to dismiss five accusations against him today, Harvey Weinstein will face rape charges.

Marisa Tomei, an Oscar winner, and Jennifer Esposito, an actress, went to court today to confront the Hollywood producer as his lawyers failed to have the charges dismissed.

Actresses Amber Tamblyn, Michelle Hurd, and Kathy Najimy, as well as Time’s Up president Lisa Borders, were among those who attended the session. “This morning we showed up in Criminal court to witness Harvey Weinstein and his case not be dismissed. It is a small victory,” Tamblyn stated in a tweet.

“But there’s a long way to go,” Tamblyn concluded. “We’ll be there again on March 7th and look forward to seeing him prosecuted to the fullest extent of the law.”

All of the women were wearing Time’s Up tees.

Weinstein’s attorneys attempted to cast doubt on the police probe into the charges, claiming that a detective’s alleged coaching of a possible witness, one of the accusers, had “irreparably tainted” the case.

They also claimed that proof of Weinstein exchanging cordial emails with his two victims after the alleged attacks should have been given to the grand jury.

A member of law enforcement also urged one of the ladies to erase text messages, they argued.

However, Judge James Burke’s decision dealt a severe setback to Weinstein’s defense team.

‘The court finds that there is no basis for the defendant’s claim of prosecutorial or law enforcement misconduct in the proceedings, or pervasive falsity in and around the Grand Jury presentation,’ Burke wrote in his judgment.

‘Moreover there is no basis in law that the conduct of law enforcement must be imputed to the prosecutor. ‘

“The defendant may explore any issues of witness credibility at a trial should such witnesses testify,” the judge said in his conclusion.

Benjamin Brafman, Weinstein’s defense attorney, expressed disappointment with Burke’s decision but expressed confidence that Weinstein will be “completely exonerated” at trial.

“We intend to vigorously defend this case to the best of our ability,” Brafman told reporters following the hearing.

“It does not in any way suggest that the case against Mr. Weinstein is going to end badly.”

The date for the next hearing has been scheduled on March 7.

Weinstein is accused of raping a female acquaintance in his hotel room in 2013 and conducting a forceful sex act on another woman in 2006.

Time’s Up was founded at the start of this year in reaction to the #MeToo reckoning of sexual harassment tales that surfaced in the aftermath of many assault and harassment allegations levied against Weinstein in October 2017.
